In a recent lawsuit, a man tragically died after consuming a highly caffeinated beverage sold by a well-known restaurant chain. The lawsuit claims that the restaurant failed to adequately warn the man about the dangerously high levels of caffeine in the drink. According to the lawsuit, the man consumed multiple servings of the chain’s “Charged Lemonade,” which contained caffeine levels alleged to be significantly higher than typical beverages.
Panera Bread faces a wrongful death lawsuit linked to its Charged Lemonade, which is now blamed for the death of a second individual, Dennis Brown. According to the lawsuit filed in Superior Court in Delaware, Brown, a 46-year-old resident of Fleming Island, Florida, consumed three Charged Lemonades at a local Panera. Unbeknownst to him, these drinks contained high levels of caffeine, and he suffered a fatal cardiac arrest while walking home.
Brown allegedly had a chromosomal deficiency, developmental delays, ADHD, and high blood pressure. He was not a consumer of energy drinks, and the lawsuit claims there were no adequate warnings at Panera indicating the high caffeine content in Charged Lemonade. The drink, which was not marketed as an energy drink, was positioned alongside less-caffeinated beverages, leading to potential misconceptions about its safety.
This case follows a similar complaint filed by the family of Sarah Katz, a 21-year-old college student who died in September 2022 after consuming the same Panera beverage. The Katz lawsuit highlighted that Charged Lemonade contained more caffeine than energy drinks like Red Bull and Monster combined, yet lacked appropriate consumer warnings.
In response to the initial lawsuit, Panera has allegedly reportedly made several changes, including reducing the caffeine content in Charged Lemonade, adding clearer warnings, and placing the product behind the counter to restrict easy access.
Panera, however, continues to deny any connection between its product and the reported deaths, maintaining the safety of its offerings. The company, owned by German investment firm JAB Holding Co., operates over 2,000 locations in the U.S. and Canada and has expressed sympathy for the affected families while disputing the claims of the lawsuits.
