We’ve come quite a long way from the days when no one thought twice about getting in the car and not fastening the seat belt. Not surprisingly, some cars didn’t even come with seat belts.
Today, most of us know how important it is to wear our seat belts. We buckle up because we all know that in the event of a car accident, the seat belt can restrain us in place and help decrease the risk of serious harm. We know how dangerous it is and how badly we could get hurt if we were tossed around the car during a collision. In fact, the National Highway Traffic Safety Administration (NHTSA) estimates that 15,000 lives each year are saved in the United States simply by wearing seat belts.
So what happens when your seat belt buckle breaks upon impact during a crash? It may be no different than not wearing one at all! If your buckle breaks or if you simply are not wearing your seat belt, then there is nothing to restrain you and keep you relatively in place in the event of a crash. Like anyone who doesn’t wear their seat belt, you could be sent flying upon impact and be seriously hurt.
Injuries that could occur if your seat belt broke or if you simply weren’t wearing one may include:
It does seem unusual and probably unlikely that impact could be forceful enough to break your seat belt, but this can actually happen in 2019 Porsche Cayennes.
In December 2018, Porsche Cars North America, Inc. issued a recall, which notified 2019 Porsche Cayenne owners of a manufacturing defect affecting the rear passenger side seat belt buckle.
According to an investigation by the NHTSA, the seat belt buckle might break under load, such as the event of a car accident. If the buckle breaks, then the passenger will not be restrained and could be seriously injured during a crash.
The faulty seat belts may constitute a manufacturing defect because the manufacturer failed to comply with the requirements of Federal Motor Vehicle Safety Standard (FMVSS) number 209, “Seat Belt Assemblies,” during the assembly and testing of the seat belts.
To pursue a claim against Porsche for harm caused by a manufacturing defect, the plaintiff may need to show the following:
It’s hard to imagine strapping yourself or perhaps your child into the back seat of a car and not being sure it will keep you safe. Unfortunately, Porsche owners may be unknowingly taking this risk.
