Life insurance companies will often try to deny legitimate policies without fully investigating the facts. Many policies provide coverage for accidental death or dismemberment. We see these claims frequently denied or delayed when investigating accident life insurance policies. Generally, if the life insurance policy was in place for more than 2 years, it cannot be denied except for non-payment. If the policy was in effect, it may still be investigated for material misrepresentation, but many of those types of claims may still be payable.
When it comes to an accidental life insurance policy, a life insurance company typically cannot deny coverage for a material representation if the policy was in force for more than 2 years.
AIG Direct says that Accidental Death and Dismemberment Insurance, or AD&D Insurance is there to help protect you and your family if you are seriously injured or killed in an accident. The policy can provide financial benefits if you are killed or lose a limb, suffer blindness, or are paralyzed in a covered accident.
Some accidental death life insurance policies also provide an additional common carrier benefit or automobile benefit. To qualify for the Common Carrier benefit under a Farmers policy, for example, the accident causing the death must occur when the insured is riding as a fare-paying passenger in or on a licensed public conveyance operated by a common carrier on its regularly scheduled route according to their website.
Life insurance policies often have different language in the policy terms and definitions as to what is covered and what is not. We will typically review the facts surrounding the death and the language in the policy to see how clear the exclusion is and whether there are any other provisions which may afford coverage.
A Federal Insurance Company policy which provides coverage to certain State of Florida employees gives some examples of incidents the policy would not cover. Their website says this policy does not apply to the extent that trade or economic sanctions or other laws or regulations prohibit us from providing the insurance. In addition no benefits will be paid for any Accident caused by or resulting from any of the following: 1) an Insured Person’s emotional trauma, mental or physical illness, disease, pregnancy, childbirth or miscarriage, bacterial or viral infection, bodily malfunctions or medical or surgical treatment thereof. (This exclusion does not apply to an Insured Person’s bacterial infection caused by an Accident or by Accidental consumption of a substance contaminated by bacteria.); 2) any occurrence while an insured person is incarcerated after conviction; 3) an insured person participating in military action while in active military service with the armed forces of any country or established international authority. (This exclusion does not apply to the first 60 consecutive days of active military service with the armed forces of any country or established international authority.); 4) an Insured Person’s suicide, attempted suicide or intentionally self-inflicted injury; 5) a declared or undeclared War.
These exceptions to coverage may not be absolute though. Sometimes the life insurance company may waive any argument or may be estopped from raising the exception. There are also many times where a death may be accidental, where the life insurance company argues the exception applies. We can review the policy and circumstances surrounding the death to see whether the claim is still payable.
Our office has recovered benefits under several AD&D policies which were initially denied or delayed. Some examples of life insurance claims which may still be payable depending on the specific facts or policy language:
Example: The insured was driving in a car when a tree fell on the car and killed the man. The life insurance company argued it was an Act of God and tried to deny coverage. Through our investigation, we successfully argued that the incident fell within the policy definition of an accident, and the full benefits were paid.
Example: A claim was initially denied where an insured overdosed on prescription pain medication. The life insurance company initially argued that the insured committed suicide. However, toxicology confirmed that the death was the result of toxicity from medications the person was supposed to take, and the death was an accident.
Example: An insured is shot and killed. The insurance company may argue it was a purposeful act, however the circumstances of the shooting could lead to the conclusion that it was accidental and the policy is payable.
