$Confidential Recovery for a lady on her honeymoon who underwent several mouth surgeries after she was served a blended drink on a cruise which contained shards of glass. Our investigation revealed that the bartender violated policy and used another glass to fill new glasses with ice. The ice bucket became contaminated with broken glass and the bartender did not realize this when he mixed our client’s drink and blended the glass right into it.

$Confidential Recovery for passenger who burned his hand on a heat lamp as he reached for food. The boat made a sudden and unexpected turn and caused the man to lose his footing and strike the lamp. The lamp was so hot that it scarred the man for life.

Crime Victim Civil Claims

$Confidential Sexual Assault – Recovery for a hotel guest who was sexually assaulted while she was sleeping in a hotel room. The assailant was served alcohol at the hotel and was kicked out of the bar. Rather than escort him to his room, they pointed him in the room’s direction. He broke into our client’s room, stole money and then attempted to sexually assault her. A background check revealed that the assailant was on probation in his home state for alcohol-related offenses.

$2,500,000.00 Shooting – Settlement for man shot at an apartment complex in Miami.

$Confidential Sexual Assault – Recovery for a customer at a Used Car Dealership who was sexually assaulted by the car salesman as he drove her around to test drive a vehicle. The police declined to press charges after the salesman denied the claims. Through discovery, we located another customer who was victimized by the same salesman the year prior and filed a police report against him. The dealership knew about the prior allegation but did nothing to protect the public.

$1,000,000.00 Policy Limit – Settlement for family whose father was killed after being shot at an apartment complex.

$Confidential Molestation – Recovery from day care where a young child was sexually assaulted by another student.

$Confidential Shooting – Settlement for young man injured after being shot in the face by a BB gun.

$Confidential Sexual Assault – Recovery for a customer at a major fast food chain who was sexually assaulted by the store’s manager in the store bathroom. The customer asked the manager for the bathroom key since it appeared the bathroom was closed. The manager escorted her to the bathroom then followed her in, where he then attempted to fondle her and kiss her. She was able to escape and the manager was charged with criminal battery. We won the case against the restaurant.

$Confidential Molestation – Settlements from three defendants where a young man was sexually assaulted in a mall bathroom.

$Confidential Molestation – Recovery for a young girl who was molested by a Church pastor at an overnight event. The church tried to buy off our clients to get them to fire their attorneys if they “forgave them” for the wrongs of the pastor.

$Confidential Molestation – Recovery for an 8 year old severely autistic girl who was molested by a janitor at a private special needs school. The State Attorney’s Office lost the case at trial because the young girl could not talk about what happened to her. We let the evidence speak for her and won the civil case. Through another teacher and 911 tapes, we were able to show how calls were immediately placed to the police stating that the janitor was found in a closet with the young child. Our investigation also revealed a history of complaints made to the school and DCF about the janitor by other child victims.

$Confidential Molestation – Settlement for a 2 ½ year old boy who was sexually assaulted by a teacher’s aide during nap time.

$Confidential Shooting – Recovery for a high school boy in northern Florida who was shot in the eye with a BB Gun.

$Confidential Assault and Battery – Recovery for a Tampa man who fractured his skull and required surgery when he was pushed down the steps of a busy bar.

$250,000.00 Molestation – When the family of a 7 year old girl moved into their trailer park, they paid a background check fee. A few months later, their daughter was molested by a neighbor. Our thorough investigation revealed the presence of several convicted sex offenders living in the community. We also conducted a background check on the molester and found that he was charged with molesting his own child prior to our client’s incident. The trailer park denied liability and alleged that they had no notice of the neighbor’s background. The child will receive payments to help with counseling for the rest of her life as part of the settlement.

$250,000.00 Drunk Driving – Settlement for victims of tissue injuries with minor surgical procedure.

$100,000.00 Molestation – Policy limits were recovered on behalf of a young girl who was molested by her father. Insurance generally excludes immediate family members from coverage. We were able to get around this argument after finding that the grandparent knew about the repeated molestations and continued to allow the father to molest the daughter after she was removed from the home.

$100,000.00 Molestation – Policy limits were recovered for a girl who was molested by her friend’s dad over a 2 year period. Our investigation revealed a significant criminal record on the molester which the molester’s family hid from our client.

Wrongful Death

$4,150,000.00 Car Accident – Settlement for the family of a young man killed by a hit and run driver in Florida.

$2,450,000.00 Drowning – Settlement for family of young girl following a drowning.

$1,200,000.00 Automobile Accident – Recovery for family of young girl killed when a tractor trailer struck her vehicle from behind.

$1,000,000.00 Automobile Accident – Recovery for the family of teenager killed when her uncle fell asleep at the wheel of a car in Miami and slammed into a wall. The girl was sleeping in the backseat at the time of the crash.

$1,000,000.00 policy limit – Wrongful death settlement for man who died and others injured when their van crashed.

$Confidential Automobile Accident – Recovery for two minor children whose mother was killed after being run over by 5 vehicles as she crossed the street. We settled with several vehicles since nobody could tell which vehicle killed the victim.

$Confidential Automobile Accident – Recovery for the surviving spouse whose husband was killed in Orlando when he crossed the street and was struck by two vehicles. We settled the case against both vehicles.

$Confidential Automobile Accident – Recovery for the mother of a young boy killed when the boy’s friend sped down a dirt road and accidentally flipped the vehicle.

$Confidential Dram Shop / Alcohol Liability – Recovery against a Palm Beach bar for the family of a 19 year old vehicle passenger who was killed after he was ejected from an SUV at 100 MPH on the Florida Turnpike. The driver of the vehicle was drunk. Our client was served underage at the bar and it was argued that he would not have gotten in the vehicle with a drunk driver if his faculties were not impaired.

$Confidential Crime Victim’s Rights – Recovery against a local gas station for the family of a 29 year old man who was shot in the face at point blank range by a crazed gunman. The gas station tried to argue that their insurance policy excluded intentional acts.

$Confidential Crime Victim’s Rights – Recovery for the mother of a boy who was shot at close range by an acquaintance as the acquaintance was showing off his gun. The gunman claimed that the gun accidentally discharged and the police declined to press charges. We won the case against both the gunman and the owner of the home where the shooting took place.

$Confidential House Fire – Recovery for the father of a 3 year old boy who died in his sleep when a trailer he was staying in caught fire in the middle of the night. The boy and his mother died in the fire. We were able to recover against the Mobile Home owner, the Tenant and the excess carrier for the owner of the mobile home. A prior attorney dropped the case and told the client there was no chance of recovery.

Drunk Driving Victims

$Confidential (Bad Faith) Recovery for young man who was left as a tetraplegic following a head on motor vehicle crash caused by a drunk driver. The drunk driver died in the accident, but left our client with catastrophic life changing injuries. As part of the recovery, we were able to reduce his health insurance lien from over $650,000.00 down to $25,000.00.

$4million+ Recovery for the family of a young man killed when a drunk driver struck him as he was going down the street. The drunk driver fled the scene and was later caught.

$Confidential Corporate liability for punitive damages – Confidential recovery for a woman who sustained soft tissue injuries when a landscaping truck driven by a drunk driver cut her off and caused a crash. We successfully argued that while insurance coverage generally does not apply to punitive damages, Florida law permits insurance companies to pay for punitive damages when the company was independently negligent in allowing a drunk driver to use their vehicle.
